Terms and conditions for using Tiny Tortilla's AI-powered business solutions and services.

Welcome to Tiny Tortilla LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, AI Receptionist services, and related products and services (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Acceptance of Terms
By creating an account, booking a demo, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Services
Tiny Tortilla provides AI-powered business solutions, including but not limited to:
- AI Receptionist services for handling inbound and outbound calls
- Call audio recording and transcription with speaker identification
- CRM and calendar integrations (e.g., HubSpot, Google Calendar)
- Workflow automation tools and integrations
- Appointment scheduling and booking management
- PII redaction for transcripts where applicable
3. Account Registration
To access certain features of our Services, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Promptly update your account information as needed
- Accept responsibility for all activities that occur under your account
4. Acceptable Use
You agree not to use our Services to:
- Violate any applicable laws or regulations, including TCPA, HIPAA, CCPA/CPRA, GLBA, CAN-SPAM, or other state and federal laws
- Infringe upon the rights of others
- Transmit harmful, offensive, or inappropriate content
- Interfere with the operation of our Services
- Attempt to gain unauthorized access to our systems
- Make calls without proper consent as required by applicable law
5. Client Compliance Responsibilities
As a business client using our Services, you are responsible for:
- Obtaining proper consent from your customers for communications as required by TCPA and other applicable laws
- Ensuring HIPAA compliance if applicable to your industry or use case
- Complying with CCPA/CPRA requirements for California residents
- Maintaining appropriate Do Not Call (DNC) lists and honoring opt-out requests
- Ensuring your use of our Services complies with all applicable state and federal regulations
We support your compliance efforts through opt-out handling, DNC list management, and consent record maintenance.
6. Third-Party Service Providers
Our Services integrate with and rely upon trusted third-party providers, including:
- Retell AI: Powers our AI voice and conversational capabilities
- n8n: Automation workflows for service integrations
- Google Calendar: Appointment scheduling integrations
- CRM Platforms (e.g., HubSpot): Customer relationship management integrations
- Cloud Hosting and Infrastructure: Secure data storage and processing
- Transcription Services: Audio-to-text conversion with speaker diarization
By using our Services, you acknowledge and consent to your data being processed by these third-party providers in accordance with our Privacy Policy.
7. Payment Terms
If you subscribe to paid Services:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable unless otherwise stated
- We reserve the right to change pricing with 30 days’ notice
- You are responsible for all applicable taxes
8. Communications Consent
By using our Services or providing your contact information, you consent to receive communications from us including:
- Service Communications: Emails, text messages (SMS/MMS), and notifications related to your account and our services
- Marketing Communications: Information about new features, products, or offerings
You can opt out of marketing communications at any time by following the unsubscribe instructions in our messages or contacting us directly. Transactional and service-related communications necessary for service delivery may not be opted out of.
9. Data and Privacy
Your use of our Services is governed by our Privacy Policy, which describes how we collect, use, and protect your information. Key points include:
- We act as a service provider (processor) on behalf of business clients (controllers)
- We may process call audio, transcriptions, call metadata, and CRM integration data
- We apply PII redaction to transcripts where applicable
- We do not sell your personal information
10. Data Retention
We retain personal information and service records for a minimum of seven (7) years to comply with legal, accounting, and audit requirements. Call logs, consent records, and compliance documentation are maintained for this period. After the retention period, data is securely deleted or anonymized.
11. Intellectual Property
All content, features, and functionality of our Services are owned by Tiny Tortilla and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.
12. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINY TORTILLA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
14. Indemnification
You agree to indemnify and hold harmless Tiny Tortilla LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorney’s fees) arising from:
- Your use of our Services
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your failure to obtain proper consents from your customers
- Any claims brought by third parties related to your use of our Services
15. Termination
We may suspend or terminate your access to our Services at any time for any reason, including violation of these Terms. Upon termination:
- Your right to use our Services will immediately cease
- We may retain your data as required by our data retention policy
- Provisions that by their nature should survive termination will remain in effect
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new effective date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in Sheridan, Wyoming, conducted by a mutually agreed-upon arbitrator. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding.
You agree to waive any right to a jury trial or to participate in a class action lawsuit.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tiny Tortilla regarding your use of our Services and supersede any prior agreements.
